1. Scope of Application

1. Scope of application, provider and conclusion of contract
1.1 These General Terms and Conditions shall apply to all orders placed by consumers (§ 13 BGB) via the online shop of SEG Sonnenrepublik Energie GmbH, Kaiserdamm 14, D-14057 Berlin, Germany, which can be called up at www.sonnenrepublik.de
1.2 The product presentations in the online shop serve for the submission of a purchase offer. By clicking the button [PURCHASE NOW] you submit a binding purchase offer.
1.3 Our products are sold only for private use in normal household quantities.
1.4 We can accept your offer/order (see point 1.2.) by sending a separate order confirmation by e-mail or by delivering the goods (see point 4.). Confirmation of receipt of the order shall be effected by an automated e-mail immediately after the order has been sent and shall not constitute acceptance of the contract.
1.5 Should our order confirmation contain typographical or printing errors or should our pricing be based on technical transmission errors, we shall be entitled to contest the order. Payments already made will be refunded to you immediately.
1.6 The contract text is not stored by us.

2. Prices

The prices quoted on the product pages include the statutory value added tax. Other price components are indicated in the legal form.

3. Shipping Costs

3.1 For delivery within Germany and Austria we charge a flat rate of 4.50 EUR per order. The respective costs for a delivery abroad can be found under “Shipping costs” in our shop.

3.3 SEG Sonnenrepublik Energie GmbH shall bear the shipping costs for delivery within Germany and Austria for orders of 100.00 EUR or more.

4. Terms of Delivery and Reservation of Self-supply

4.1 Unless otherwise stated in the offer, the delivery time shall be 10 days from receipt of payment.
4.2 If not all ordered products are in stock, we are entitled to partial deliveries at our expense.
4.3 Should the delivery of the goods fail despite two delivery attempts, we may withdraw from the contract. Any payments made will be refunded to you immediately.
4.4 If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we can withdraw from the contract. In this case we will inform you immediately and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or if you do not wish to receive a comparable product, we will immediately refund you for any services already rendered.

5. Terms of Payment

5.1 The payment takes place alternatively by prepayment/transfer or by PayPal.
5.2 When selecting the payment method prepayment, we will give you our bank details in the order confirmation. The invoice amount must be transferred to our account within 5 days.

6. Retention of Title

The goods remain our property until full payment has been made. Prior to transfer of ownership, pledging, transfer by way of security, processing or transformation is not permitted without our consent.

7 Liability

7.1 We exclude our liability for slightly negligent breaches of duty, insofar as these do not concern essential contractual obligations (so-called cardinal obligations), damages from injury to life, body or health or guarantees or claims under the Product Liability Act are affected. Essential contractual obligations are those whose fulfilment makes the proper execution of the contract possible in the first place and on whose fulfilment you may rely.
7.2 The same applies to breaches of duty by our vicarious agents and legal representatives.

8. Final Provisions

8.1 These General Terms of Use regulate the contractual relationship comprehensively and conclusively. Amendments and supplements must be made in writing in order to be effective. This also applies to the cancellation of this written form clause.
8.2 Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. Instead of the invalid provision, the relevant statutory provisions shall apply.
8.3 The law of the Federal Republic of Germany shall apply to the exclusion of the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) and the German Commercial Code.
